Update on Lot 505
To all Legend at Bergamont Estates HOA members:
There have been recent developments regarding Lot 505, the large vacant lot on Winged Foot Drive adjacent to the Bergamont pool parking lot.
As you are probably aware, this property has been for sale for the past couple of years. The developer of our subdivision, Fiduciary Real Estate Development, Inc. sold it in January 2026 and the new owners relisted it for sale shortly thereafter.
Within the past few weeks, a new buyer has entered into a contract with the current owners to purchase the property for development. This buyer has been in discussions with the HOA regarding some of their concepts for development and wants to work with the HOA to create a development that fits with the character of the rest of our subdivision. Given other scenarios that could have played out for Lot 505, this is a VERY POSITIVE situation.
There are still a lot of steps required for the buyer to get to the point of having a detailed plan ready for implementation, including gaining Village of Oregon approval. The buyer is having his initial meeting with the Village Planning Commission on April 9 to review preliminary concepts for development and discuss a possible change in zoning to allow single family homes consistent with the rest of our subdivision. The property is currently zoned for multi-family. No decisions will be made at this meeting.
There are very few specific details to share at this time. The buyer's planning and due diligence efforts are expected to take more than 3 months. We intend to stay in contact with the buyer and the Village during this period.
As development plans come more clearly into focus and meaningful information becomes available that can be shared with our membership, we will keep you up to date.

Special Ice Rink Rules for 2025-2026 Winter Season

Background
Ice rinks are not specifically addressed in the Restrictions and Covenants but have been covered at least twice over the past few years in written statements mailed to our members by Fiduciary Real Estate Investments, LLC, the developer of our subdivision. The most recent of these statements was written in 2023 - a copy of that is available if you'd like.. As with their previous statement, issued during the Covid-19 pandemic, this statement provided conditions under which our members were allowed to build/install recreational ice rinks on their property, but only for the upcoming season.
You may recall that in the letter that was sent to our members this summer, we pointed out things that have been common violations of the restrictions and covenants to create greater awareness. Included was the following:
Recreational Equipment. We expect families to use their backyards for
recreational activities and allow the use of swing sets, trampolines, soccer goals, volleyball nets, etc. Only permanent hard courts and temporary ice rinks are not allowed.
Since the letter was sent, we have received several calls regarding this policy and have had discussions regarding it with some of our members. As a result, we have decided to adopt the following policy.
Temporary Ice Rinks will be allowed for the upcoming winter season under the following conditions:
1. Rinks must be pre-approved by the Architectural Control Committee. Contact

2. Maximum size is 20' x 40'. Maximum height of side boards is 2'
3. Rinks are allowed only in the back yard and must not be visible from the street.
4. Rinks may be installed after November 1 and must be removed by March 31.
5. Consideration must be given to the flow of water onto adjoining properties in the
event of melting conditions during the season and at the end of the season.
6. No additional lighting or music systems may be installed.
7. Rinks must not be used after 8:00 PM
This policy will be reviewed at the end of the season. Input from our members in areas where rinks have been installed will play a significant role in the decision to make the policy permanent. As with all our restrictions, the spirit of the rule is to ensure a safe, attractive and enjoyable neighborhood for our members and their families. Please consider how your use of a rink may impact your neighbors.
